Sim Racing Experience Terms and Safety

1. Acknowledgment of Risk

I understand that participation in the Thermaltake racing simulator experience involves certain inherent risks. These risks may include but are not limited to dizziness, motion sickness, muscle strain, minor injury, or injury caused by interaction with simulator equipment including steering wheels, pedals, seats, or motion platforms.

The simulator equipment used during this event may include professional-grade force feedback steering systems capable of producing strong rotational forces and motion systems that move while the simulator is operating.

I acknowledge that these forces may cause injury if equipment is used improperly or if safety instructions are not followed.

2. Assumption of Risk

I voluntarily choose to participate in the racing simulator activity and fully assume any and all risks associated with participation, whether known or unknown.

I accept full responsibility for any injury, discomfort, or damages that may occur during or after participation.

3. Release of Liability

To the fullest extent permitted by law, I hereby release, waive, and discharge Thermaltake Inc. (the “Company”), its owners, employees, contractors, partners, sponsors, event organizers, venue operators, and affiliates from any and all liability, claims, demands, damages, or causes of action that may arise out of or relate to my participation in the racing simulator activity.

This includes but is not limited to claims arising from negligence, equipment malfunction, or any other cause.

4. Agreement to Follow Safety Instructions

I agree to follow all instructions and safety guidelines provided by event staff.

I understand that failure to follow instructions, misuse of equipment, or unsafe behavior may result in immediate termination of my participation without warning.

5. Physical Condition

I certify that I am physically capable of participating in the simulator activity and that I do not have any medical condition that would make participation unsafe, including but not limited to heart conditions, epilepsy, seizure disorders, severe motion sickness, recent injuries, or other medical limitations.

I understand that if I begin to feel discomfort, dizziness, or nausea, I should immediately inform staff and stop participation.

6. Equipment Use Warning

I acknowledge that the simulator may use high-torque force feedback steering equipment and/or motion systems that move during operation. I agree to keep my hands, feet, and body within designated areas and to use the equipment only as instructed by staff.

7. Right to Refuse Participation

The Company reserves the right to refuse or terminate participation if a participant appears intoxicated, impaired, unsafe, or unable to follow instructions.

8. Personal Property

The Company is not responsible for any lost, stolen, or damaged personal property during participation in the event.

9. Photo and Media Release

I grant permission for the Company and its representatives to photograph or record video of my participation for marketing, promotional, or documentation purposes without compensation. By providing your email, you also consent to receive marketing communications from Thermaltake USA. You may unsubscribe at any time.

10. Severability

If any portion of this agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

11. Access to Race

Access to racing simulator rigs is subject to availability and may involve wait times. Racing simulator experience prizes are managed by Thermaltake USA staff and are limited. We apologize for any delays, interruptions, or technical issues that may occur. By participating, you acknowledge that this is a simulated experience and agree to follow all staff instructions; Thermaltake USA is not liable for any discomfort or issues arising from participation.

Acknowledgment

I have read this waiver and release of liability, fully understanding the terms, and voluntarily agree to its conditions. I understand that I am giving up certain legal rights by clicking the button on the right to agree fully to these Safety and Liability of any and all potential risks involved while participating. 

Parent or Guardian Consent (Required for Participants Under 18)

If the person(s) are under 18, as the parent or legal guardian of the minor participant, you hereby agree that you have read and understand this waiver and consent to their participation.
